We build mobile websites, which are easily accessible to all, and place a high focus on accessibility and usability. We have the experience and ability to do everything we’ve agreed with our clients and we’ll do it all in a professional and timely manner.
1.0 PLACING AN ORDER
1.1 Receipt of a signed Order Form and / or Deposit Payment from a client signifies intent that the client agrees to contract us to develop their mobile and/or web site. Work will commence immediately ensuring we deliver the project on time, as such the client acknowledges that from this point they will be responsible to honor all payments as set out on the payment schedule and no refunds will be issued should the client change their mind for any reason. Refunds will only be issued where Vista Mobile fail to deliver the services as outlined in this agreement.
2.0 ORDER DELIVERY AND SIGN OFF
2.1 Upon completion of the site build, the client will be given access to a test environment and can propose layout & design changes at this time at no additional charge. Once the client is happy with the layout & design they will be asked to confirm this in writing.
3.0 SITE SETUP
3.1 For full website setup we will require access to the clients server control panel and FTP account so that we can upload the new website files. If the client does not already have website hosting we can host the website for them.
3.2 In the case of mobile sites, we will provide the client with a unique URL for their mobile site, the client will also have the option to change this to a bespoke URL using an extension of their existing domain URL (e.g. m.clientsite.com).
3.3 The client will also be provided with a site redirect code to be placed after the head tag of their index.html file, which will activate the automatic mobile redirection.
3.4 We will provide the client with clear instructions for both the setup and implementation of the custom URL and site redirection. Should the client wish for us to do this for them, we offer this service free of charge once supplied with access credentials to the client’s server control panel.
3.5 Due to the bespoke software used, the delivered mobile site must be hosted on servers arranged by Vista Mobile and cannot be transferred away from these servers. Mobile hosting is included in our annual Site Management Fee.
4.0 SITE MANAGEMENT
4.1 We charge an annual Site Management Fee as detailed on the Order Form, which includes site hosting, mobile site reporting (monthly) and up to 4 hours content management service per year.
4.2 Whilst not anticipated, should our server costs increase at any time we reserve the right to amend the hosting fees to our clients giving a minimum of 3 months notice.
4.3 Where Site Management fees remain unpaid, we reserve the right to suspend the site on our servers, restricting access.
5.1 All content on the delivered sites remains the sole property of the client and the client is wholly responsible for the licensing and copyright of content and images.
5.2 We love to show off our work and share what we have created, so we reserve the right, with permission, to display and link to client’s sites as part of our portfolio and to write about it on websites, in magazine articles and in books.
6.1 By providing us with access to their server control panel the client understands that Vista Mobile accepts no liability for any loss of data and/or content and as such it is essential that the client has secured a backup of all data and settings on their server before sending us their server login credentials.
6.2 In no event shall we be liable to a client for lost profits or special or consequential damages. Our total liability for damages, costs and expenses, regardless of cause, shall not exceed the total amount of fees paid to us by the client.
7.0 PAYMENT SCHEDULE
7.1 The exact payment schedule is detailed on each client´s Order Form, however our standard Payment Schedule terms are as follows…
- 1/3 Deposit Payment at time of Placing An Order
- 2/3 Balance Payment at time of Order Delivery + Annual Site Management Fee
7.3 The client’s website WILL NOT LAUNCH LIVE to the internet or viewable to the general public until both Development fees and Site Management fees have been paid in full.
7.4 We contact our clients annually; one month in advance of their Site Management expiry date to ensure the invoice for the following 12 months is delivered and paid. Failure to pay the Site Management fee before the expiry date will result in the client’s mobile site being suspended from our servers.
